NBSA noted that the subject matter of the program was news worthy and was based upon data that was already in the public domain. In view thereof the NBSA did not consider it fit to proceed further with the matter. However the NBSA observed that while reporting on sensitive matters such as defence related subjects, which may impinge on the country’s national security, broadcasters should be circumspect and exercise discretion and air such stories only if these were in public interest and did not pose any imminent threat to national security. The complaint was closed.

The complainant stated that the channels should stop telecasting comedy shows and reality shows instead of news programmes.

NBSA decided that the observations made by the viewer were relevant and should be borne in mind inasmuch as the comedy programs and other nonnews programs should not be excessively run on news channels; and even when telecast such nonnews programs should comply with standards of good taste and decency in order to improve broadcasting standards. The complaint was closed.

The complainant alleged that the content regarding Nirmal Baba was objectionable and had hurt her and her family’s sentiments.

S.NO 674. Channel Aaj Tak Complainant Mr. Yudhisthir Sharma Date of Broadcast 20.2.2012 Complaint

The complaint was against the program named "Vishesh" telecast on the channel. The title of the program was "Dhoni ki Beimani". The complainant alleged that the telecast was an attempt towards defaming Indian Cricket Team Captain Mahendra Singh Dhoni. The program quoted exceprts from Kapil Dev's Interview in "Seedhi Baat" on Aaj Tak telecast on Aaj Tak Channel on 19th Feb 2012. Kapil Dev did not say anything against Mahendra Singh Dhoni in the programme despite numerous attempts being made by the host of "Seedhi Baat" however, quotes by Kapil Dev from "Seedhi Baat" were being used in isolation in "Vishesh" being presented by Mr. Sameep Rajguru to draw conclusions againast Mahendra Singh Dhoni.

NBSA noted that the title of the program was ex-facie derogatory and indicated prejudice and bias ; and decided that to that extent the broadcaster had violated the guidelines relating to “impartiality, objectivity and neutrality”. NBSA decided that the broadcaster be warned and they be also informed that they should be cautious in the use of language which was evidently derogatory. The complaint was closed.

S.NO 675. Channel Asianet (Non- Member) Complainant Mr. C.V. Kannan [MoI&B] Date of Broadcast 23.6.2011 Complaint

The complainant stated that the channel in the programme titled “Viswasichalum Illenkilum had portrayed a very poor and sorrowful situation of his house, including the video of his mentally ill wife with narrations which were totally false and baseless. By giving narrations in the programme, the channel made the viewers to believe that he and his family was under starvation, he was a full time drunkard and his son was maintaining him and his wife from the income which he got from the rowing of boat etc. All the narrations and videos in the said programmes were totally defamatory, sheer intrusion to his private life and programme was produced and telecasted without his consent or knowledge.

Since the broadcaster is not a member of NBA, NBSA therefore decided that a communication be sent to the Minister for Information & Broadcasting drawing her attention to the lacunae in handling complaints of non members and also to furnish to them the details of cases where no response had been received from non-member broadcasters. Only on receipt of a communication from MIB, would the complaint be considered. The complaint was filed.

NBSA noted that since the matter was nearly a year old and there was no further communication from the complainant, NBSA did not consider it fit to proceed further with the matter and decided that the matter be closed. MIB was informed accordingly.

S.NO 677. Channel TV9 Mumbai Complainant Mr. Russell Fernandes Date of Broadcast 5.3.2012 Complaint

The complaint was regarding a programme titled “Unexplained water dripping from the Holy Crucifix” at Parle, Mumbai, aired on the channel. The complainant alleged that the program was atrocious and disrespectful. In a shocking display of hatred and vindictiveness, the programme expressly targeted the Church and the Pope using profane language and unleashed incitement to religious hatred .Mother Mary was called an eternally sobbing woman and loosely, deliberately and willfully made blatant mockery of Jesus Christ and other Christian beliefs.

NBSA noted that the complainant was called to their Mumbai studio and since the matter was clarified by both parties, the matter may be closed only after getting a confirmation from the broadcaster that the grievance had been redressed and that he does not intend to pursue the matter. The complainant vide email dated 22.4.12, had informed NBSA that in view of the broadcaster having aired a programme in which the subject matter was clarified, the complaint may be treated as closed.

The complaints filed by 6 complainants stated that the channel while airing a programme, regarding rumors in Mumbai of kidnapping of kids” in the past two months by a “monkey man” , to verify these rumors Star Majha had telecast a special report which is alleged was for the sole objective to address the incorrectness of the said rumors, and in the process insulted and humiliated the original inhabitants, the Adivasi community.

NBSA viewed the alleged programme and noted that there was a mention of a community. NBSA noted that immediately on receipt of various complaints, the broadcaster had taken corrective action to apologize on their channel on 5.3.12, which apology was conveyed to all the complainants. NBSA decided that since there was no further communication from the complainants, the matter be closed.

S.NO 680. Channel News24 Think First Complainant [MoI&B] Date of Broadcast 29.6.2011/11.7.2011 Complaint

MIB stated that the visuals shown on the news report about atrocities on children It was stated that the act of torture shown in the telecast was disturbing and was only a superstition. Due to a prevailing practice in Katihar, Bihar, small children were being subjected to torture in the name of treatment. An instrument meant for cutting grass was made hot in fire and then it was touched on the stomachs of children. They wept bitterly, in vain, while their rights to get treatment and care, were being denied.

NBSA was of the view that the intent of airing the story was unexceptionable, namely to bring to light occult practices being followed in certain parts of the country of inflicting severe pain upon children in the mistaken belief of preventing disease and in the garb of religion and custom, which practices are to be deprecated. However, the intent of airing the story by the channel could have been adequately served without needless repetition of gruesome and gory visuals, which were completely unnecessary, out of context and not in good taste. NBSA decided that the channel be advised to observe more sensitivity in that regard and be informed that future transgressions would be dealt with severely. NBSA observed that no further action was required in the matter. MIB was informed of the decision. The complaint was closed.
