NBSA noted that it could not take action under its regulations in respect of language used by a guest in a “live show”. If the complainant was offended she could take recourse to the law of the land. The matter be closed and MIB and the broadcaster be informed accordingly.

S.NO 642. Channel Aaj Tak Complainant Mr Kiran Raj Shelar [MoI&B] Date of Broadcast 18.3.2012 Complaint

The complaint was regarding telecast of “Superhit Muqabala” on the channel. The complaint was received from MIB vide letter dated 22.6.2012.

NBSA noted that as was the procedure,vthe broadcaster was advised to submit details of the broadcasts which were considered by the NBSA. It was decided that the response received from the broadcaster be forwarded to the complainant and if the complainant was satisfied the matter be closed. The MIB also be informed accordingly.

S.NO 643. Channel Times Now Complainant Mr. Sabyasachi Mitra [MoI&B] Date of Broadcast Complaint

MIB forwarded the complaint which stated that in the programme, Mr. Arnab Goswami, anchor of the programme was referring to a State Government Order which had listed the newspapers that was to be kept in the State libraries. The complainant stated that the Order was a simple order so that there was a proper list and same standard was maintained across all libraries and the budget could also be kept in check.The complainant alleged that the Editor-in-Chief made a statement that the media had been “censored”; media was being “gaged” The biased and irresponsible comments it is alleged was made to defame the Chief Minister of the West Bengal could lead to negative sentiments which can impact growth and discourage investors.

MIB forwarded a complaint against telecast of programme ‘Third Eye of Nirmal Baba’ on various TV channels Mr. Sunil Kumar, Section Officer, MIB, forwarded complaints of 7 individuals, including the report of Mr. Anil Chamadia, which he had already submitted to NBSA. The MIB had also given the report of EMMC. The CD and the report of EMMC were forwarded to member channels i.e. Aaj Tak, Total TV, IBN7, P7 News & India TV.

NBSA noted that the MIB while forwarding the complaints had drawn the attention of the NBSA that despite issuance of MIB Advisory dated 29.11.2011 advising all channels to telecast programmes with due care and maturity, strictly adhering to programme code, particularly in respect of programmes that appear to encourage superstition and blind belief, the above programmes shown by TV channels were in violation of Rule 6 (1) (j) “encourages superstition or blind belief” of the Programme Code. The NBSA took note of the same and decided that the complaints relating to Nirmal Baba would be considered in totality.

MIB had informed NBSA that news channels Manorama News (NBA Member), Kalaignar TV, Raj TV, Asianet News (non-members) had shown visuals of dead bodies; two channels i.e. TV100 (non member) had showed a rape victim without blurring her face and Samay (non member) had shown “Andhvishwas Ki Salakhein” and also programmes on Nirmal Baba. In the same letter MIB had also drawn the attention of NBSA that Aaj Tak, IBN7, India TV, P7 News, Total TV, Sony, SAB, AXN and Star Utsav were also showing programmes on Nirmal Baba.

NBSA considered the complaint regarding visuals of dead bodies shown by Manorama News and noted that prima-facie the broadcaster had violated/breached the Specific Guidelines relating to reporting the dead which interalia states that “the dead must be treated with respect. Close-ups of dead or mutilated bodies should not be shown”; and decided that a notice be issued’ NBSA considered the reply given by Manorama News and decided that the channel be issued a warning for violation of the NBSA guideline relating to reporting of the dead. NBSA also decided that the broadcaster be asked to submit in writing details of action taken by the broadcaster to sensitize its editorial personnel to prevent such violations in future.

Complaints received by India TV and responded to relate to various programmes on Nirmal Baba (19), Paul Dinakaran (1) & Sri Satya Sai Baba (1).

The NBSA considered all the above complaints and decided that the CD’s along with the study received from Mr Chamadia be forwarded to the media monitoring agency for a report to ascertain whether there have been any violations by broadcasters of the guidelines issued by NBA/ NBSA inter alia guidelines proscribing the spreading of superstition, occultism and blind belief as also guidelines relating to paid-news. Being conscious of the fact that certain matters challenging broadcast of programmes relating to Nirmal Baba and other similar persons are pending before various courts of law, the NBSA decided that a view would be taken on whether the NBSA can take up the matter and if so, which aspect of it. This will be decided after further consideration of the matter.

The complainant alleged that the channel was broadcasting a paid advertisement of Nirmal Baba and it was a clear breach of NBA guideline of "Refraining from advocating or encouraging superstition and occultism".

The complainant brought to the notice of the Chairperson, NBSA that Media Studies Group had done a study on Nirmal Baba and manipulation of TRP on different T.V. Channels. Media Studies Group in its study found that race of earning more TRPs among few news channels by telecasting “paid” slot of “Third Eye of Nirmal Baba” seemed a product of loopholes in TRPs system which requires an urgent attention. The complainant had desired that the Study be treated as a complaint in the interest of society particularly viewers of T.V. channels.

The complaint alleged that, just 3 days before the polling of bye elections in Andhra Pradesh the channel relayed a press conference by one Mr. K. Mohan who made wild allegations of giving Rs.5. to 10 crores to Mr. Chandrababu Naidu, President, TDP in 1999.
