The complaint was regarding telecast of news item relating to floods in Bikaner. The complainant in his complaint had stated that the news item had misled his relatives residing in Delhi and Uttaranchal.

The complaint was regarding showing Mr. M.S. Dhoni “live” in their programme titled “Chukde cricket”. The complainant alleged that the broadcaster was giving the impression to the viewers that the questions and answers of Mr. M.S. Dhoni were “live” whereas the actual fact was that the answers were used by the channel were which were given by Mr M.S. Dhoni’s during his post match interview at Sri Lanka to journalists.

NBSA decided to close the matter with the observation that the broadcaster in future should bear in mind the advisory dated 16.9.2011 and be cautious in relation to the use of caption “Live” to avoid misrepresenting to the viewers.

S.NO 624. Channel News18 Uttar Pradesh/Uttarakhand Complainant Mr. Anil Kumar Baweja, Managing Director, Lord Vishwakarma Heat Exchangers Pvt. Limited, Haridwar, Uttrakhand Date of Broadcast 12.10.2012 Complaint

The complaint was regarding a news telecast regarding the dispute of Lord Vishwakarma Heat Exchangers Pvt. Limited, Haridwar Vs Mahendra Kumar Khatri, which they alleged that the news was totally manipulated and only one sided statements were shown to tarnish their image, which was totally wrong and unfair to them as the full truth was not shown by the broadcaster which was their prime duty.

NBSA noted that as per the information submitted by Editor of ETV UP/Uttrakhand the matter appeared to have been amicably settled between the parties. Notwithstanding the purported settlement of the matter, NBSA observed that complaints relating to such violations had been received against the same broadcaster earlier-on; and the channel seemed to take no cognizance of the observations made by NBSA. NBSA therefore decided that since the matter involved issues of broadcasting standards with larger ramifications, the NBSA would proceed against the broadcaster under its Regulations in future. The decision of the NBSA was, accordingly, conveyed to the broadcaster.

S.NO 625. Channel Aaj Tak & Headlines Today Complainant Ms. Louise Khurshid, Project Director, Dr.Zakir Husain Memorial Trust, Rural Outreach Programme Date of Broadcast 9.10.2012 & 10.10.2012 Complaint

The complaint was against a programme titled “Operation Dhritraashtra” that was telecast on Aaj Tak channel as a part of a Special Report and a similar programme was aired on Headlines Today and broadcast a number of times on the news channels.

NBSA noted that subsequent to filing of the above complaint with the NBSA, Ms. Louise Khurshid, Project Director of Dr. Zakir Hussain Memorial Trust had filed a suit on the subject matter before the Hon’ble High Court of Delhi,. NBSA noted that since the matter was sub judice it would not be able to proceed under the NBSA regulations. The complaint was closed.

S.NO 626. Channel Zee News, Zee Business and Zee News UP Complainant Jindal Steel & Power Ltd. Date of Broadcast 7.9.2012 till 13.9.2012; and then from 24.9.2012 to 26.9.2012 Complaint

NBSA took suo motu cognizance of the matter and called upon the broadcaster, to respond within 7 days as to why action be not taken against them for broadcast of the captioned programmes in their channels. They were called upon to respond to every allegation made in the complaint regarding demand of a sum of Rs.100 crore over a period of 4 to 5 years in the name of advertisements of their company. The complainant and the broadcaster were called for a hearing.

NBSA noted that subsequent to the NBSA taking suo motu cognizance of the complaint under its Regulations, the complainant had filed a defamation suit in the Bombay High Court and had also filed an FIR alleging extortion / demand of Rs 100 Crores towards advertisements for stopping reportage on coal block allocations to Jindal Steel and Power Ltd.. NBSA noted that since the matter was sub judice it would not be able to proceed under the NBSA regulations. and the matter be closed However, the complainant was informed that, if so advised, the complainant would be at liberty to approach the NBSA if any issue within NBSA’s remit survives for consideration after conclusion of the legal proceedings. The complaint was closed.

S.NO 627. Channel Headlines Today Complainant Mr. D.K. Pandey, CPRO, ITBP Date of Broadcast 26.07.2012 Complaint

The complaint was regarding telecast of a story about Indo-China relations in which Shri Ranjit Sinha , DG ITBP was being attributed with some false statements. Shri Ranjit Sinha had never talked or issued any such statement to Headline Today or any other news Agency. The statements being attributed were totally baseless and false

NBSA was of the view that attributing the statement to ITBP DG was a serious error. NBSA was of the view that the error was certainly due to lack of due diligence, accuracy and verification of facts and therefore failure to observe the guidelines issued by the NBA/ NBSA .NBSA decided that as stated in their reply ,the broadcaster be asked to submit details of the requisite action initiated against the concerned producer and also decided that the broadcaster be directed to sensitize its producers and other concerned persons in this regard.The broadcaster had once again apologized for the error and had stated that the producer had been reprimanded and warned and that appropriate action had been initiated to sensitize their producers and other concerned persons to avoid any compromise on the basic norms of accuracy and due diligence. The complaint was closed.

S.NO 628. Channel INDIA TV Complainant Mr. Shivam Mohla, Mr. Ankush Kattarmal, Mr. Himanshu Chaudhary Date of Broadcast 22.6.2012 to 27.6.2012 Complaint

The complaints were filed by three Devotees of Kumar Swami ji regarding a programme aired on the channel. Three devotees had alleged that wrong news was aired by India TV thereby hurting emotions and religious belief of the devotees and also of the language used in the broadcasts.

NBSA noted that the devotees had no reason to complain as their Guru Kumar Swamiji had been given sufficient air time by India TV where he was invited to their studio to present his views on the various allegations leveled against him .The complaints therefore be closed and the complainants informed accordingly.

S.NO 629. Channel Zee News & Zee 24 Tass Complainant Mr. Ejaz Ahmed Aslam, National Secretary (Media), Jamaat-e-Islami Hind Date of Broadcast 19.8.2012 & 20.8.2012 Complaint

The complaint was regarding the news item which stated “Pakistan’s ISI had hatched a conspiracy to spread rumours to destabilize India. In this connection it had given money to Jamaat-e-Islami also along with some other terrorist organizations”. The complainant alleged that the telecast gave a wrong impression about the Jamaat-e Islami Hind. Jamaat was a well-known, respectable, reputed and peace loving organization which had been working throughout India for the last 60 years. This telecast had damaged the reputation of the Jamaat-e-Islami Hind and given rise to misunderstandings among a large number of people.

NBSA decided that there was substance in the complaint inasmuch as when reference was made to controversial organizations and persons, news channels must be cautious and use the complete and accurate name of such organizations and persons to ensure no confusion was caused with others who may have similar names. NBSA decided that the broadcaster be directed to carry an appropriate corrigendum to clarify that no reference was made or meant in their news report to the “Jamaat-e-Islami-Hind.”. The complaint was closed.
