NBSA at its meeting held on 15.11.2012 had decided that the matter be closed only after ascertaining from the broadcaster in writing regarding the strict internal filters that they have put in place to avoid such aberrations occurring in the future and also to intimate the action taken against the person responsible for the same. The NBSA considered the response on 20.2.13 and noted with satisfaction the actions taken by the broadcaster to ensure prevention of such mistakes in the future. Accordingly, NBSA decided to close the matter. MIB was informed accordingly.

S.NO 602. Channel INDIA TV Complainant Mr. T.P.S Bagga [MoI&B] Date of Broadcast 11.11.2011 Complaint

The complainant stated that a sting operation was telecast under the name of “Operation 10th December”, which he alleges was to create “horror and terror in the mind of general public; depicted half truth by tampering the actual recordings; the programme breached the Programme Code and also used provocative language.

NBSA at its meeting held on 15.11 2012 noted that to consider the matter in the light of the allegations made by the complainant, it may be ascertained from Mr. T.P.S. Bagga in writing as to what is his exact allegation regarding “tampering” of the telecast and also which provision of the Programme Code had been violated by the broadcaster. The response received from the complainant would be thereafter considered by NBSA. NBSA noted that there was no response to the letter dated 11.12.12 sent by Speed Post to the complainant. The NBSA therefore decided to close the matter. MIB was informed accordingly.

S.NO 603. Channel Z24, Sahara Samah, Sadhna News (Non-members) & ETV Chhatisgarh Complainant [MoI&B] Date of Broadcast Complaint

MOI&B brought to the notice of NBSA certain news items, which had appeared in the Indian Express and Hindu on 7th & 8th December, 2012 that the channels referred to had received payment for airing favourable news items/ reports for the Government of Chhatisgarh.

NBSA considered the complaint of its member channel and directed the broadcaster to submit the CD containing the offending broadcasts. The broadcaster informed NBSA that the allegation that ETV Chhatisgarh had broadcast paid news was incorrect. Therefore, there would not be any footage relating to the complaint, which can be provided by ETV Chhatisgarh for consideration by NBSA. Further, the broadcaster had also stated that it had routinely produced news stories on the success of the Chhatisgarh Government and broadcast these as stories; that such success stories of Chhatisgarh Government, released by State Public Relations Department, are broadcast on the channel, as advertisement or sponsored items and not as news ; and that the channel has never received any consideration in cash or kind, for broadcasting any favorable news items/reports for the Government of Chhatisgarh, as alleged in some print media and when any matter was released by the Public Relations Department on any development programmes, such matter was telecast only as advertisement but not as news. NBSA decided to close the matter with the rider that if MoI&B is able to furnish the CD the NBSA would re-open the complaint.

The complaint is regarding astrology programmes shown on various channels. The complainant alleged that self certified and self appointed astrologers use the TV channels to promote their dishonest profession.

NBSA considered the complaint in the context of the fundamental right of freedom of expression. NBSA noted that there are adequate guidelines issued in this regard by NBA/ NBSA, which are required to be followed by the broadcasters while telecasting such programmes.

NBSA considered the above complaints and decided that the above broadcasts be reviewed by a monitoring agency to ascertain violations of the Code of Ethics, Specific Guidelines other Guidelines and Advisories issued from time to time. NBSA considered the synopsis prepared based on the report received from the Monitoring Agency regarding the alleged violation by broadcasters with regard to the above broadcasts. The NBSA decided that individual broadcasters be informed of the violations with respect to the above broadcasts and in particular the number of times the episodes were repeated so that they can take corrective actions for future broadcast to improve broadcasting standards. It was decided that the Monitoring Agency would be commissioned to continue the screening and monitoring of broadcasts of member channels and would submit reports to the NBA, which reports will then be actioned as may be deemed appropriate.

S.NO 606. Channel ABP News Complainant Dr. P.B. Desai & Association of Medical Consultants, (AMC) Mumbai Date of Broadcast 15.12.2012 & 16.12.2012 Complaint

The complainants alleged that it the programme titled “Second Opinion” aired on the channel on 15.12.2012 and 16.12.2012, the contents were glorified and dramatized in its incorrect form. it is alleged that the broadcaster had aired only one sided story and had not bothered to get it verified from the concerned parties i.e. hospital and himself.

NBSA considered the complaints and noted that the matter was sub judice and pending before the Hon’ble Supreme Court of India. Since the matter was sub judice, NBSA was unable to entertain the complaint at this stage. However, they were at liberty to revive the complaint before NBSA, if so advised and found necessary, upon conclusion of proceedings pending in Hon'ble Supreme Court.

S.NO 607. Channel Manorama News Complainant [MoI&B] Date of Broadcast 26.3.2012 Complaint

MIB stated that the news channel had shown still photos of a Tibetan protestor who immolated himself at Jantar Mantar, New Delhi. Such photos should not have been telecast as these are not in good taste and also are not suitable for unrestricted public exhibition. The channel had violated the provisions of the Cable Rules.

NBSA noted that although the broadcaster may have used the footage provided by ANI but they should have, as per NBSA Guidelines, masked the gory and disturbing visuals of the Tibetian protester. NBSA decided to close the matter with the observations that the broadcaster be advised to be more careful in the future, failing which transgressions in the future would be dealt with sternly.

MIB stated that the news channel in their programme on Valentine’s Day had showed visuals of couples getting intimate at public places which were in violation of the Cable Rules.

NBSA noted that the broadcaster in their reply had admitted wrongdoing; and the programme had certainly invaded the privacy of individuals and was unnecessarily salacious. NBSA issued to the broadcaster a strong reprimand for not bearing in mind the Code of Ethics and Regulations and that the broadcaster be informed that they should be careful in this behalf in future and that any such violations hereafter would be dealt with severely.

S.NO 609. Channel IBN 7 Complainant Patanjali Yogpeeth/Divya Yog Mandir Trust Date of Broadcast 4.10.2012 Complaint

The complaint was regarding programme titled “Guru Gumshuda & Gunah” telecasted on the channel in which there was direct allegations against the Trust and Swamy Ramdev, who was one of the Trustees that they were responsible for the disappearance of Swami Shankardev and that they had influenced the authorities to close the case, which was clearly without any basis and was an abuse of journalistic freedom.

NBSA considered the legal notice, response given to the legal notice by the broadcaster and a separate complaint before the NBSA on the same subject. NBSA noted that since the CBI was investigating the issue of disappearance of Swamy Shankardev, the NBSA need not proceed in the matter in view of the NBSA Regulations.The complaint was closed.

S.NO 610. Channel CNN IBN Complainant Mr. Nagarajan Thinniam Date of Broadcast 21.7.2012 Complaint

The complaint pertained to the news item about Karnataka Govt.'s move to arrange for prayers in all the temples. The complainant stated that the correspondent was heard saying something to the effect that why should water be poured and money wasted on stones when there was no water available for drinking. These sorts of words were unwarranted and hurt the feelings of practicing Hindus who offer worship in temples and prostrate before statues.

NBSA noted that the complaint appeared to be based purely upon the complainant’s personal views and opinions on the news anchor’s comment that using water for religious ceremonies while there was otherwise shortage of water in the State of Karnataka was un-justified. While in its response the broadcaster had accepted its error, the NBSA was of the opinion that the matter did not warrant any action, except to observe that broadcasters should be conscious of the sensitivities of people, especially in relation to matter of religion and faith. NBSA decided that the matter be closed with the above observation that the broadcasters should be careful when airing such matters.
