29.8.2021 The complainant registered his grievance regarding the shows aired on TV9 Bharatvarsh about a "Maha Maanav" and a "5000 year old plane" that claimed that US security forces found in a cave in Afghanistan. The complainant stated that the entire broadcast had absolutely no truth to it, however the channel, on multiple occasions, used terms like "fact", "truth", "proof", "expose", "as per the soldiers", "as per forensic report", etc. to mislead the viewers into believing that the information shared in the broadcast was factual. Moreover, he stated that the channel also showed unrelated, false and misleading visuals during these broadcasts. For example: Videos of Bryce Canyon National Park, Utah (USA) was falsely shown as visuals of Afghanistan's caves and terrains. That it was only towards the end, in one of the clips, it was mentioned that there is no statement from the US on this, nor are there any eyewitnesses and this was a work of imagination that was viral on social media. Therefore, the complainant stated that by airing the impugned show the channel violated the following Fundamental Standards mentioned under NBSA's Specific Guidelines: A. All news reporting must be done in “public interest”. B. Reporting should not create distress or undue fear among viewers. C. ‘Content’ of matter broadcast should not be shown out of ‘context’. D. Subjects which promote horror, supernatural, superstition, occultism, exorcism, divination, and the paranormal should be avoided. Additionally, the channel also violated Guidelines around Accuracy and Good Taste.

8.1.2022 NBDSA considered the complaint, response dated 5.9.2021 from the broadcaster and viewed the footage of the broadcast. After considering the broadcast in its entirety, NBDSA decided to advise the broadcaster that in future before airing such programmes, it should prominently state that the contents shown in the programme are unverified and a work of imagination. NBDSA decided to close the complaint with the above observation and inform the complainant and the broadcaster accordingly.

S.NO 32. Channel Times Now World Complainant Mr. Sharad Shah Date of Broadcast 7.7.2021 Complaint

7.7.2021 I noted during News Hour yesterday (July 7th, 2021) that Mr. Shehzad Poonawala was properly introduced rather belatedly as a Times Now Contributor. Perhaps you can further clarify what is meant by “contributor”. Is this a voluntary service offered by friends of the channel? Or are they compensated for the service? Please let me know whether it is proper journalism to have a contributor as an additional participant in debates which creates an environment of echo chamber vitiating a free and fair debate as you already have your own anchor to give direction to the debate and exercise reasonable control. It is an infringement on the principles relating to Impartiality and objectivity in reporting.

8.1.2022 NBDA considered the complaint and the response dated 9.8.2021 from the broadcaster. NBDSA was of the view that it was the editorial discretion of the broadcaster as to which guest/ panellists/contributors it invited to the programme on its channel and in the given circumstances this act of discretion was not found lacking bona fide or objectivity. In view of the above, NBDSA found no violations of the Code of Ethics & Broadcasting Standards & Guidelines and decided to close the complaint and inform the complainant and the broadcaster.

29.6.2021 The complaint was filed against the journalist and the broadcaster for for violating the Code of Ethics and principles of Self-Regulation in the programmes aired on 26,.5.2021 and 28.5..2021, at primetime. The impugned broadcasts, in consonance with the previous broadcasts of Zee Hindustan on the issue, continued to allege a conspiracy on part of the farmers protest to spread coronavirus. On several occasions in the past, the anchors of zee had made similar allegations against members of the minority community or dissenters of the Government of a conspiracy to spread corona, by holding religious gatherings (tabhilighi jammat hotspot incident) , or protests against the government's policies.

8.1.2022 NBDSA, at its meeting held on 8.1.2022, considered the complaint regarding three programmes aired on Zee Hindustan between 24.05.2021 and 03.06.2021. After going through the complaint, NBDSA noted that there was a delay in filing the complaint with the broadcaster as under Proviso 1 to Regulation 8.1.6 of News Broadcasting Standards Regulations (a complaint is required to be filed with the broadcaster within 7 days from the date of the first broadcast. In view of the above, NBDSA held that it is not in a position to entertain the complaint on merits and therefore, decided to dismiss the above complaint on the ground that it was filed beyond the period of limitation permitted under the Regulations. NBDSA decided to close the complaint and inform the complainant and the broadcaster accordingly.

S.NO 35. Channel ABP News Complainant Mr. Indrajeet Ghorpade Date of Broadcast 6.9.2021 Complaint

2.10.2021 The complaint was in respect of a show titled Sansani aired by ABP News on 6.9. 2021: https://news.abplive.com/videos/crime/rohtak-murder-case-actual-reason-behind-the-brutal-murders-sansani-06-sept-2021-1480676. The title of the show itself is "sansani" which means sensational. NBDSA's Code of Ethics prohibits sensationalisation of murders. By showing pictures of the deceased and by showing animated visuals of guns firing shots at these people in the images in their foreheads, all accompanied with superimposed audio of gunshots was extremely sensationally, in utterly poor taste (also a violation of the policy around good taste and decency). Additionally, the show repeatedly called the gay relationship between the accused and his boyfriend impure and disgusting. This was extremely shocking to watch.

NBDSA at its meeting held on 10.7.2020 considered the complaint, response from the broadcaster and decided to call the complainant and the broadcaster for a hearing at its next meeting. At the hearing held on 26.11.2020, after considering the submissions of both the complainant and the broadcaster, the Authority had decided to call both the parties for a further hearing on 18.2.2021. However, on 18.2.2021 (the date of hearing) the complainant failed to appear before it. Thereafter, a further opportunity was given by it to the complainant to appear for the hearing scheduled on 24.9.2021. In response, the complainant vide email dated 23.9.2021 informed the Authority that he did not wish to pursue further with complainant as it had been a long time since it was filed. NBDSA decided that since the complainant vide email dated 23.9.2021 had informed that he did not wish to proceed further with the complaint, the complaint was being closed and MoI&B, complainant and the broadcaster be informed accordingly.

S.NO 37. Channel News18 India Complainant MoI&B Date of Broadcast 15.6.2020 Complaint

2.7.2021 Vide letter dated 2.7.2021, the MoI&B requested the Authority to examine complaints forwarded by it regarding insult of Hazrat Khawaja Syed Moinuddin Chisti by Mr. Amish Devgan during the debate on “Aar Paar” aired on News18 India on 15.6.2020.

NBSA considered the letter dated 2.7.2021, received from the MoI&B requesting the Authority to examine complaints forwarded by it. NBSA noted that the broadcaster vide email dated 13.7.2021 had informed it that pursuant to the judgment of the Hon'ble Supreme Court, dated 7.12.2020 in the matter Amish Devgan vs. Union of India & Ors. [WP (Crl.) No. 160/2020], the matter is now pending investigation before IO and the Ajmer Court. NBSA observed that since the matter is sub judice under Regulation 7.2 read with Regulation 8.4.3 of the News Broadcasting Standards Regulations, it is not permissible or appropriate for NBSA to take up the matter. NBSA therefore, treated the matter as closed. NBSA decided to inform the MoI&B and the broadcaster accordingly.

S.NO 38. Channel NDTV India Complainant National Commission for Scheduled Castes (NCSC) [MoI&B] Date of Broadcast 30.3.2021 Complaint

3.5.2021/31.3.2021 The complainant alleged that Smt. Saira Shah Halim uttered “Chori Chamari” a casteist and abusive phrase during an NDTV campus debate programme held in Jadavpur University, Kolkata West Bengal which was aired on 30.3.2021 between 10pm to 11 pm. The complainant stated that although the edited video of the programme titled “Articulate Argumentative Aggressive: Voice of The Youth This Election” available on YouTube does not include the word “Chori Chamari” spoken by Smt. Halim. However, the same was witnessed by more than 20 viewers present during the programme as well as by millions of viewers on TV. The complainant stated that the Smt. Halim along with the broadcaster should be booked under SC/ST(Prevention of Atrocities) Act, 1989 for airing such casteist programme. He submitted that since the impugned programme was not aired live but rather recorded, the Editorial team of the broadcaster was responsible for not reprimanding Smt. Halim for uttering such unconstitutional words and for not editing the same before the broadcast. Further, even the news anchor did not pay attention to the fact that he was recording a casteist slur, which is a punishable act. The broadcaster in its reply dated 9.6.2021, stated that the said offending word was removed within 12 hours of the broadcast of the said programme and thus, immediate corrective action was taken by it as soon as the channel learnt about it. It stated that even the complainant has also acknowledged that the online version of the programme does not contain this term. The broadcaster stated that the matter pertained to a campus debate programme in Jadavpur University which was aired at 10:30PM on NDTV India, wherein, the said offending word was used by one Ms. Saira Shah Halim. The complete transcript of her statement is provided below: “Ye 2019 mein Lok Sabha ka jab chunaav hua tha toh bhot sare ilako mein constituencies mein gun barood... kya kehte hain tola bazi illegal money bhot yaha pe jo hain spread ho raha tha. Abhi jo hain jo left liberal ka jo space hain left ka space hain wo apni ideology se chala rahe hain ek party ek vichar dhara. Ab aapke principle strong hain aap dekhenge ki ye Bengal ke jo adarshvadi jo yaha pe yuvak yuvika hain aadarsh ko manenge ya loot chori chamari dakaiti aur communalism ko manenge sampradayikta ko manenge” It stated that when the said offending word was used by the panelist Ms. Halim, it was not heard by the anchor on account of noise in his background with atleast 30 – 40 people present during the debate. Also, in context of her whole statement, it appears that the said offending word was mistakenly used by Ms. Halim and she wanted to say “chori chakari”. In any case, the broadcaster submitted that as soon as it learnt about the said offending word being used in the debate on the morning of March 31, 2021, immediate corrective action was taken by it.

NBSA considered the complaint, response from the broadcaster and viewed the footage of the broadcast. NBSA observed that from the context of the programme it is clear that the panellist wanted to say “chori chakari” however maybe by slip of tongue used the expression “chori chamari”. NBSA noted that no apparent offense was intended to the SC/ST community in the context of the broadcast as the expression was used inadvertently. Further since the expression was used by the panellist on the programme and not by the channel or the anchor, no fault could be attributed to the broadcaster. The Authority also noted that the broadcaster had on realization of the error on the part of the panellist immediately deleted the offensive expression from the video of the impugned programme. In view of the corrective action taken by the broadcaster, NBSA decided that no further action was called for on the complaint. NBSA decided to close the complaint with the above observations and inform the MoI&B and the broadcaster accordingly.

The broadcaster stated that impugned telecast was part of its weekly show “Seema Par” which is an informative show wherein they promote the self-reliant and self-produced defence systems of India. With respect to the allegations that the broadcaster had indulged in sharing ‘confidential’ or ‘classified’ information with respect to the Light Combat Aircraft supporting CATS warrior, it is submitted that the said telecast was part of India’s new ‘Warrior’ drone, which is part of the indigenous Combat Air Teaming System (CATS) being developed by Hindustan Aeronautics Limited along with the private sector. The information is already available in the public domain and was revealed at Aero India 2021 show held in Bangalore. The details of the HAL’s Warrior is being developed to go into combat as a loyal wingman drone with existing manned fighter jets like LCA Tejas and Rafale of the IAF to complement and maximize their effectiveness is already available in public domain and the aforesaid information are not ‘classified’ or ‘confidential’ information. The broadcaster submitted that the impugned telecast merely showed the existence of such defence systems and cannot have the effect of bringing national security at stake.

12.2.2021 The complainant alleged that on ABP News, an ignorant anchor reported that the Khalistani Flag was waved at Red Fort. He alleged that the words used by the anchor were not only false and reprehensible but were also anti national as the flag waved was not Khalistani Flag but Nishan Sahib, which is a symbol of Sikh religion. The broadcaster in its response dated 9.3.2021, stated that in the absence of exact time of telecast they are unable and incapacitated to give any effective response.

NBSA considered the complaint and response from the broadcaster. NBSA noted that in absence of sufficient details in the grievance petition, particularly with respect to the date and time of the alleged broadcast, it would not be possible for NBSA to proceed further with the complaint. However, while considering the complaint, NBSA observed that many broadcasters during the coverage of the farmer’s protest at Red Fort on January 26, 2021 had inadvertently identified the Nishan Sahib Flag (Khalsa Flag) as the National Flag. In this regard, NBSA noted that the broadcasters should exercise due care and caution while reporting any news pertaining to any religious symbol/flag and follow the Fundamental Principles of the Code of Ethics & Broadcasting Standards which states that “All news channels will keeping with the principle of due accuracy and impartiality, ensure that significant mistakes made in the course of broadcast are acknowledged and corrected on air immediately.” NBSA decided to close the complaint and inform the MoI&B and the broadcaster accordingly.
